Terms of Service
These terms govern your use of Podbite, operated by Tourbillon Labs Pty Ltd (ABN available on request), based in Australia. By using Podbite you agree to them. If you do not agree, please do not use the service.

Your Account
You are responsible for keeping your login credentials secure and for anything that happens under your account. If you suspect unauthorised access, contact us promptly.
You must be at least 13 years old to use Podbite. If you are under 18, you confirm that you have permission from a parent or guardian.
Your Content
When you create a bite on Podbite, you are selecting a timestamped segment of a third-party podcast episode and adding a caption and optional comment. You retain full ownership of the caption and comment you write.
By creating a bite, you grant Tourbillon Labs Pty Ltd a non-exclusive, royalty-free licence to display your caption and comment as part of the Podbite service, including on public bite pages and in embed players hosted on third-party websites.
Podbite does not store, host, or proxy podcast audio. The audio in any bite player is loaded directly from the podcast's original hosting provider. You are responsible for ensuring your use of podcast content is consistent with applicable copyright law and the terms of the relevant podcast.
Embeds and Account Closure
When you share a bite publicly or embed it on an external website, that embed code becomes part of the web. Podbite has no control over where embed codes are placed after you share them.
If your account is closed, Podbite will remove your profile, playlists, and personal information. However, bites you have created will remain as unattributed records. This is necessary to preserve the functionality of any embed players already placed on third-party websites — removing bites would break those embeds across the web, which is outside Podbite's ability to remediate.
When your account is closed:
- Your personal comments on bites are permanently deleted.
- Your name and profile are removed — bites will no longer be attributed to you.
- The bite caption you wrote is retained without any link to your identity, to provide context in existing embeds.
- Your playlists are deleted. Any embedded playlists you have shared on third-party websites will stop functioning.
If you wish to request removal of your captions as part of a formal erasure request under applicable privacy law, contact us at hello@podbite.link. We will respond within 30 days.
Subscriptions and Billing
Podbite offers paid plans (Promote, Curate, Automate), billed monthly or annually through Stripe.
Free trial. When you start a paid plan, you receive a 14-day free trial of that plan. No charge is made until the trial ends. You can cancel before the trial ends without being charged.
Foundation pricing. If your account was created before Podbite's public launch — whether through the waitlist or by invitation — your foundation pricing is locked in for as long as you maintain an active subscription. Foundation pricing does not carry over if your subscription lapses and you resubscribe.
Upgrades and downgrades. You can change plans at any time from Billing in your account settings. Upgrades take effect immediately and are prorated — you will be credited for unused time on your current plan and charged for the new plan from the date of the change. Downgrades take effect at the end of your current billing period; you keep access to your current plan's features until it expires.
Cancellation. You can cancel your subscription at any time from Billing in your account settings. You retain access to your paid plan features until the end of the billing period you have already paid for. Cancellation stops future charges — it does not trigger a refund for the current period.
Payment failure. If a payment fails, we will retry and notify you by email. If payment cannot be collected after the retry period, your subscription will be cancelled and access to paid features will end. Resubscribing restores access from that point forward.
Refunds. We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact us and we will investigate.
API Access
API access is available on the Automate plan. Your API key is personal — keep it secure and do not share it publicly.
Your plan includes a monthly allowance of creations via the API — bites and playlists created through the API count against this allowance. Usage resets at the start of each billing period. If you exhaust your allowance before the reset, API creation will be paused until the next period. Additional allowance is not currently available for purchase — contact us if your needs exceed your plan's limit.
We may update API behaviour with notice. We will not make breaking changes without a deprecation period, except where required for security or legal reasons.
Acceptable Use
You agree not to use Podbite to:
- Violate any law or regulation
- Infringe the intellectual property rights of others
- Upload, share, or distribute content that is defamatory, harassing, or harmful
- Attempt to gain unauthorised access to Podbite's systems or other users' accounts
- Interfere with the service or its infrastructure (e.g. denial-of-service attacks, scraping at scale without permission)
- Resell or sublicence access to the API without our written agreement
We reserve the right to suspend or terminate accounts that violate these terms, without notice where necessary to protect the service or other users.
Copyright and DMCA
Podcast audio is hosted and served by third-party providers. If you believe content on Podbite infringes your copyright, contact us at hello@podbite.link with:
- A description of the copyrighted work you claim has been infringed
- The URL of the bite or page on Podbite where the alleged infringing content appears
- Your contact information
- A statement that you have a good faith belief that the use is not authorised by the copyright owner
- A statement, under penalty of perjury, that the information in your notice is accurate
We will investigate and respond to valid notices promptly. Note that Podbite does not host or control the underlying audio — takedown requests for audio must also be directed to the relevant podcast hosting provider.
Disclaimer and Limitations
Podbite is provided on an "as is" basis. We do our best to keep it running reliably, but we make no guarantees of uptime, accuracy, or fitness for a particular purpose.
To the maximum extent permitted by law, Tourbillon Labs Pty Ltd is not liable for indirect, incidental, or consequential damages arising from your use of Podbite, including loss of data, loss of revenue, or interruption to your business.
Our total liability to you for any claim arising from your use of Podbite is limited to the amount you have paid us in the 12 months preceding the claim, or AU$100, whichever is greater.
Nothing in these terms excludes liability that cannot be excluded under Australian Consumer Law.
Changes to These Terms
We may update these terms from time to time. For material changes, we will notify you by email or by a notice in the app before the change takes effect. Continued use of Podbite after the effective date of a change constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of the courts of Australia.
